Cookie Policy

Welcome to www.fondazionelottomatica.it (hereafter the “Site“).

The Website is owned by the Lottomatica Foundation (hereinafter also “the Company“).

This Cookie Policy aims to make known the procedures followed for the collection, through cookies and/or other monitoring technologies, of the information provided by users when they visit this Website.
It is an integral part of the “Privacy Policy” of the Lottomatica Foundation.

Introduction

General information on cookies and other monitoring technologies.

It is possible that, while browsing this Website, some user information is collected passively (i.e. information that the user does not actively provide) by means of various technologies. The Company and third-party service providers passively collect and use different information in different ways, such as:

  • IP address: The IP address consists of a number automatically assigned to the computer used by the user’s Internet Service Provider (ISP). An IP address is automatically identified and recorded in the log files of the Company’s server each time users access the Website, next to the date of the visit and the page(s) visited. The collection of IP addresses is standard practice on the Internet and is done automatically by many websites. IP addresses are used for various purposes, for example to calculate the levels of use of the Website, provide useful elements to diagnose server problems and manage the administration of the Website.
  • Information through the user’s browser: most browsers collect certain information including MAC (Media Access Control) address, computer type (Windows or Macintosh), screen resolution, operating system version, and Internet browser type and version.
  • Device information: If you access the Website from a mobile device, the Company may collect information such as your mobile device type and unique identifier.

Finally, information may be collected through the use of so-called “cookies” as described below.

The definition of “cookies”.

Cookies are small text strings that the websites visited send to the user’s terminal (normally the user’s browser), where they are stored to then be resent to the websites on the user’s next visit.

Users who visit the sites will see minimal amounts of information on their device (computers and mobile devices), in small text files – called “cookies” – saved in the directories used by the User’s web browser, for variable periods of time depending on the need, generally between a few hours and a few years, with the exception of profiling cookies whose maximum duration is 365 calendar days.

The information stored on the user’s device can be reused during the same visit to the sites (session cookies) or later, even after several days (persistent cookies). Cookies are stored, according to user preferences, by a single browser on the specific device being used (computer, tablet, smartphone).

Through cookies it is possible to store semi-permanent information related to user preferences and other technical data that allow easier navigation and greater ease of use and effectiveness of the sites themselves. For example, cookies may be used to determine whether a connection has already been made between the visitor’s computer and the site visited to highlight new information or maintain login credentials.

Similar technologies, such as web beacons, transparent GIFs and other forms of local storage introduced with HTML5, can be used to collect information about a user’s behaviour and the use of services.
Please note that a cookie cannot retrieve any other data from the user’s hard disk or transmit computer viruses or acquire email addresses. Each cookie is unique to the user’s web browser.

Some of the functions of cookies can be delegated to other technologies; therefore, in the following information, the term ‘cookie’ refers to cookies and all similar technologies.

Please note as of now that the user can also express their preferences about the use of cookies on this Website (see detailed list below) in the settings of the browser(s) by following the instructions provided. The user can also set “private browsing” which allows the user to surf the Internet without storing any information about the websites or pages visited, any passwords entered or other information that could be traced back to their identity.

Types of cookies

There are various types of cookies, which differ depending on their characteristics and use, as described below.

Technical cookies

These are cookies essential for the proper functioning of a website, which are used to manage various website services (such as a login or access to the reserved functions on the sites). The duration of these cookies is strictly limited to the user session or they may have a longer duration, in order to remember the visitor’s choices. Deactivating strictly necessary cookies may compromise the experience of using and browsing the website.

Analytical cookies (analytics)

These cookies are used to collect information about the use of the sites. The information is used for anonymous statistical analysis in order to improve the use of the sites and to make the content more interesting and relevant to the user’s wishes. This type of cookie collects anonymous data about the user’s activity and how they arrived on the website. Analytical cookies are sent from the website itself or from third-party domains. They also allow for monitoring of the system and improvement of its performance and usability. These cookies can be deactivated without any loss of functionality and will be covered in detail below.

Analytics cookies from third-party services

These cookies are used to anonymously collect from the user information about website usage such as pages visited, time spent, traffic source, geographical origin, age, gender and interests, for the purposes of marketing campaigns. These cookies are sent from third-party domains external to the websites.

Cookies to integrate third party software products and functions

This type of cookie integrates features developed by third parties within the pages of the websites such as icons and preferences expressed in social networks in order to share the content of the websites or for the use of third-party software services (such as software to generate maps and other software offering additional services). These cookies are sent from third-party domains and partner sites offering their functionality across the web pages of the website.

Profiling cookies

These are cookies needed to create user profiles in order to send advertising messages in line with the preferences expressed by the user within the pages of websites.

More information about cookies can be found at www.allaboutcookies.org

In view of the obvious complexity linked to identifying technologies based on cookies and their close assimilation with the functioning of the web, users are encouraged to contact the Data Controller should they wish to receive any further information about the use of cookies themselves and any possible use of them – for example, by a third party – exercised through this Website

The requirements regarding the protection of personal data relating to the processing of cookies

Italian legislation has enacted the European Directive 2009-136-EC, which requires the operators of websites that use cookies or other monitoring technologies to inform the user about the types of cookies used by the site. The new European Regulation on the protection of personal data, No. 2016/679 (“GDPR”) has replaced the legislation on cookies by clarifying some aspects and, in any case, strengthening the protection of individuals’ data.

Recital 30 of the GDPR expressly mentions cookies:

“Natural persons may be associated with online identifiers provided by their devices, applications, tools and protocols used, such as internet protocol addresses, cookie identifiers or other identifiers such as radio frequency identification tags. This may leave traces which, in particular when combined with unique identifiers and other information received by the servers, may be used to create profiles of the natural persons and identify them.”

Recital 26, while not mentioning cookies, helps to understand that cookies are pseudonymous data, and therefore personal data. It also adds that the GDPR does not apply to the processing of anonymous information, including for statistical and research purposes (thus establishing an exemption for analytics cookies).

Relating to cookies, the Italian Data Protection Authority has issued Provision no. 229 of 8 May 2014, published in the Official Gazette no. 126 of 3 June 2014, in which it has categorised cookies into two macro-categories:

  • “technical” cookies (including analytical cookies) and
  • “Profiling” cookies

For the installation of technical cookies (including analytical cookies, collected in aggregate form) the prior consent of users is not required, while there is still an obligation to provide the information.

For the installation of “profiling” cookies, the legislation stipulates that the user must be adequately informed about the use of the same and thus express their free, specific and revocable consent.

For more information on the indications provided on the subject by the Working Group for the protection of personal data pursuant to art. 29, in particular in “Opinion 04/2012 on Cookie Consent Exemption”, adopted on 7 June 2012, and in “Working Document 02/2013 providing guidance on obtaining consent for cookie”, adopted on 2 October 2013, you can consult the documents:
